Elvis Presley rights holders sue Anthropic over lyrics to 274 songs, seek up to $41M

A unit of Authentic Brands Group, ABG EPE IP LLC, and seven other Elvis Presley rights holders sued Anthropic on Oct. 23 in the Northern District of California (No. 5:26-cv-12473). They allege Claude was trained on lyrics to 274 Presley compositions, including "Can't Help Falling in Love," "All Shook Up" and "A Little Less Conversation," without a license, and that it still produces infringing lyrics and rewrites despite guardrails. They plead copyright infringement plus DMCA circumvention and copyright-management-information removal and seek up to $41.1M in statutory damages (about $48.6M with the DMCA claims) plus an injunction. Anthropic did not immediately respond to Billboard's request for comment, and the allegations are unproven.

ABG EPE IP LLC, which Billboard describes as a unit of Authentic Brands Group, and seven other Elvis Presley rights holders have sued Anthropic, alleging that its Claude AI model was trained on the lyrics to 274 Presley songs without a license. The complaint was filed Friday, Oct. 23, in the U.S. District Court for the Northern District of California (No. 5:26-cv-12473), and no judge is named on the docket. Billboard reported the filing first. The allegations are unproven.

What the plaintiffs allege
Recovery of $150,000 for each work is requested, amounting to roughly $41 million.
The other plaintiffs are the Luigi Creatore Trust, the Susan T. Aberbach Revocable Trust, the Decedents Exempt Trust, Jason Simeon Aberbach, Abilene Music LLC and Raleigh Music Publishing LLC. They allege they own or control exclusive rights in 274 compositions listed in Exhibit A, among them "Can't Help Falling in Love," "All Shook Up" and "A Little Less Conversation." The claims concern song lyrics, not audio, and are copyright claims only. The complaint alleges Anthropic torrented pirate libraries and kept the lyrics in a permanent internal library. It also alleges Claude still outputs infringing lyrics and rewrites despite guardrails, and that titles and writer and publisher credits were stripped from the training data.

Claims and damages sought

The complaint pleads direct copyright infringement, circumvention under DMCA Section 1201 and removal of copyright management information under Section 1202. It seeks up to $150,000 for each work willfully infringed, which across 274 works is up to $41.1 million. It adds $685,000 under Section 1201 and $6.85 million under Section 1202, for about $48.6 million in total by our sum. The plaintiffs also seek an injunction, impoundment of copies and an accounting of training data.
Last week Spotify removed roughly 50 million tracks viewed as AI-generated filler from its recommendation system over the preceding year.
Counsel and context
Richard S. Busch of Adams & Reese in Nashville is lead counsel, with Skaggs Faucette in San Francisco as local counsel. The complaint says at least six suits over musical compositions are already pending in the district, including cases brought by Concord, BMG, Round Hill, Sony Music Publishing and Reservoir. Anthropic did not immediately respond to Billboard's request for comment.
