Kroger’s $1.65 billion acquisition of Giant Eagle could add over 200 stores to its 2,700 locations. The American Economic Liberties Project warns the deal would widen Kroger’s customer surveillance network, including Flock cameras and Cooler Screens, for data collection and personalized pricing. The group urges regulators to block the merger, citing similar privacy concerns that blocked Kroger’s Albertsons bid in 2024.

Kroger's proposed $1.65B acquisition of Giant Eagle could expand customer surveillance, the American Economic Liberties Project (AELP) says in a new report, The Verge reports.
"The Ohio attorney general and Federal Trade Commission should sue to block" the merger, the report says.

Flock cameras. The report cites the Columbus Dispatch for the claim that Kroger's private Flock cameras share footage with Columbus police.

The deal. Kroger is buying all of Giant Eagle, Inc., which has 197 supermarkets, 11 standalone pharmacies and about $9B in annual sales. The $1.65B price is $1.25B in cash plus about $400M in assumed liabilities. The deal is expected to close in 2027, subject to the HSR antitrust waiting period, with "limited" divestitures expected.
